Where a suit is withdrawn by the plaintiff under Order XXIII, Rule 1 of the Code of Civil Procedure

A. Neither of the defendants therein can apply to be transposed as plaintiff

B. Any of the defendants thereto can apply to be transposed as a plaintiff as a matter of right
