Section 401 of the Code of Criminal Procedure, 1973
1. Allows the Court to convert finding of acquittal into conviction
2. Allows the Court to pardon the pardon
3. Does not allow the Court to act suo motu
4. Is only applicable to High Court

Supreme can review the decision to grant a pardon and declare it invalid if it finds that the pardon was granted arbitrarily, in bad faith, or violated fundamental principles of justice, otherwise pardoning power rest solely in the president or the governor as the case may be
